The Results Are In: The USPTO’s Request for Comments on Discretionary Denials
Join us as we review one of the most closely monitored rule changes in the AIA's history. The USPTO recently issued a request for comments regarding policy-based discretionary denials of PTAB proceedings. Such policy-based discretion includes the PTAB's recent rise in considering: (a) parallel litigation (Fintiv Factors/NHK Spring); (b) parallel petitions; and (c) serial petitions when deciding whether to institute. We will review the proposed rule, the policy and practical considerations involved, and the competing interests which resulted in over 800 comments being submitted from stakeholders.

Amplifying Underrepresented Voices at the PTAB
We will review some of the current diversity issues in the PTAB bar, such as those highlighted in the PTAB Bar Association’s 2019 Report on Women at the PTAB and The ABA and NALP’s After the JD III: Third Results from a National Study of Legal Careers. We will also look at efforts being made to diversify the bar, including the PTAB’s LEAP initiative. Our in-house counsel panelists will discuss their endeavors to ensure diversity in outside counsel and provide tips that both in-house and firm counsel can employ to increase the diversity of their own staffs.

Proving Up Printed Publication Status in a Pandemic
We will discuss how to establish a reasonable likelihood that a non-patent document qualifies as a printed publication in IPR proceedings in view of the Board's precedential opinion in Hulu, LLC v. Sound View Innovations, LLC, IPR2018-01039, Paper 29 (PTAB Dec. 20, 2019). We will also look at the challenges of obtaining evidence of public accessibility of documents posed by the pandemic and discuss possible ways to address this issue.
