With the further increased duration of nullity proceedings before German patent courts, the bifurcated patent litigation system in Germany is effectively limited to an infringement dispute. The “infringed, but invalid” scenario dominates the negotiations for any settlement between parties. These developments are expected to sustainably push active enforcement in general and particularly NPE patent litigation.
Hence the need for collaborative strategies against NPEs, which actively seek the monetization of patents by asserting or litigating against operating companies, drives producing entities to react.
In the US, the large scale of NPE litigation has led to various collaborative offensive and defensive solutions to reduce costs. Can market-based solutions like Unified Patents help deter NPEs in Germany and Europe from making dubious patent assertions as they do in the US?
