Equitable IP's Optic153 adverse judgment granted

On May 23, 2022, the PTAB entered adverse judgment with respect to claims 1, 16, 19, 21, and 22 (all challenged claims) of U.S. Patent 6,115,174, owned by Optic153 LLC, an Equitable IP entity, in IPR2021-00932 filed by Unified Patents. After the PTAB instituted trial, Optic153 filed a statutory disclaimer with the USPTO disclaiming the challenged claims. The PTAB treated Optic153's disclaimer as a request for adverse judgment as to the challenged claims and granted the request.

The '174 patent is generally related to devices that vary optical signals and had been previously asserted against Comcast, Verizon, T-Mobile, Windstream Holdings, Dish Network, Charter Communications, Crown Castle International Corp., and AT&T.

Adverse Judgment Granted in Arsus IPR

On January 27, 2021, the PTAB issued an order granting request for adverse judgment in Unified Patents, LLC v. Arsus, LLC. Arsus disclaimed every claim challenged in IPR2020-00948, U.S. Patent 10,259,494 (claims 1-5, 8-12, 21, and 22).

Lighthouse cancels patent as the result of Unified's challenge

On September 2, 2020, the Patent Trial and Appeal Board (PTAB) granted Lighthouse Consulting Group’s request for adverse judgment and cancellation of all instituted claims in IPR2020-00194 filed by Unified. This request comes after the PTAB’s decision to institute trial for U.S. Patent 8,590,940, directed to image-based check depositing technology. Lighthouse asserted this patent over 30 times. The defendants in these cases were primarily banks and financial services companies such as Wells Fargo, Citigroup, Charles Schwab, AMEX, Bank of America, Capital One, Morgan Stanley, Ally Financial, JP Morgan, and BB&T. Wells Fargo also filed an IPR petition challenging claims of this patent in April 2020.
