IP Edge sub, Orbit Licensing, communications patent successfully challenged

On November 18, 2022, the USPTO issued a final rejection of claims 1, 4-6, and 9-11 of U.S. Patent 9,578,040, owned and asserted by Orbit Licensing, an IP Edge entity. The '040 patent is generally directed to packet communications, including determining whether a service request is authorized or not. The '040 patent has been asserted 10 times, including against the SPF protocol (an open standard of the IETF) of several companies such as EidosMedia, Red Hat, OnApp, Akamai, Tencent, Limelight Networks, Wowza Media, CodePen, Velocix, and The MathWorks.

DynaIP entity, Silent Communication, telecom patent reexam granted

On October 21, 2022, less than two months after Unified filed an ex parte reexamination, the USPTO granted Unified’s request, finding substantial new questions of patentability on the challenged claims of U.S. Patent 8,229,409, owned by Silent Communication, LLC, an NPE and DynaIP entity. The ’409 patent relates to recovering calls after an erroneous disconnection and has been asserted against Adobe, Fuze, and Lifesize.

PacSec3 '564 reexamination successfully challenged

On September 23, 2022, the USPTO issued a final rejection of all challenged claims of U.S. Patent 7,047,564, owned by PacSec3, an NPE. PacSec3 was formed in 2020 with NACAR IP LLC as its managing member. NACAR IP was also formed in early 2020 with Dynamic IP Deals, LLC (d/b/a DynaIP), a patent monetization company, identified as its managing member. The ‘564 patent had been asserted against F5 Networks, NetScout Systems, Palo Alto Networks, McAfee, Cisco, Juniper Networks, and Watchguard Technologies.

Sound View '860 patent successfully invalidated

On September 16, 2022, the USPTO issued a notice of intent to issue a reexamination certificate, canceling claims 1-3, 5, 7, 8, 10, and 18 of U.S. Patent 8,135,860, owned by Sound View Innovations, LLC. The ‘860 patent relates to data processing that transforms web content into a format suitable for display by a client device and was previously asserted against Facebook.

Route Guidance Systems patent challenged

On September 2, 2022, Unified Patents filed an ex parte reexamination proceeding against U.S. Patent 6,917,876, owned by Route Guidance Systems LLC, an NPE. The ’876 patent is directed to route guidance systems for vehicles where the calculated route is transmitted from a central computer to a vehicle over a channel of communication in a short burst and is then closed, so that transmission to the vehicle ceases, unless and until a need for further transmission arises. The patent is currently being asserted against ExxonMobil, Verizon, MyPizza Technologies, Honda, Salesforce, Grubhub, HERE Global, DoorDash, MapleBear, and Waitr.
