Intellectual Ventures Open Source/Kubernetes patent challenge instituted

On June 14, 2024, less than three weeks after Unified filed an ex parte reexamination, the Central Reexamination Unit (CRU) granted Unified’s request, finding substantial new questions of patentability on the challenged claims of U.S. Patent 7,949,785, owned by Intellectual Ventures II LLC. The ‘785 patent relates to a system of communication via virtual networks. It has been asserted against JP Morgan Chase Bank, Liberty Mutual Holding Company, and Comerica. The ‘785 patent is purportedly related to open source container orchestration systems for automating computer applications, such as Kubernetes. This filing was a part of Unified’s ongoing efforts in the Open Source zone.

European Patent Litigation and Non-Practicing Entities: A Large and Looming Threat

JUVE Patent has published an article written by Jessica L.A. Marks, SEP & Foreign Managing Counsel at Unified Patents, over the growing presence of US-based Patent Assertion Entities (PAEs) spreading into Europe. Eight out of the top ten most active NPEs in Europe are US-based companies. However, NPEs are a large and growing part of the European landscape and are poised to increase with the introduction of the UPC.

DynaIP entity, Autonomous IP, self-driving patent challenged

On June 11, 2024, Unified Patents filed an ex parte reexamination proceeding against U.S. Patent 10,127,818, owned and asserted Autonomous IP, LLC, an NPE and DynaIP entity. The '818 patent is directed to autonomous vehicle navigation including detecting and avoiding emergency vehicles. It has been asserted against Tesla and Lyft.

$2,000 for CardiacSense monitoring patent prior art

Unified Patents added a new PATROLL contest, with a $2,000 cash prize, seeking prior art on at least claim 1 of U.S. Patent 7,980,998, owned by CardiacSense LTD, an NPE. The ‘998 patent relates to methods, systems, and devices for monitoring activities performed by a person, and for allowing communication with respect thereto, in particular where such activities includes sports, e.g. swimming. It has been asserted against Garmin, Coros Wearables, and Suunto.

$2,000 for Advanced Meter Systems meter reading patent prior art

Unified Patents added a new PATROLL contest, with a $2,000 cash prize, seeking prior art on at least claim 1 of U.S. Patent 7,088,239, owned by Advanced Meter Systems, LLC (f/k/a Akoloutheo, LLC). The ‘239 patent relates to an apparatus for remote utility meter reading, including responses at the premises to fires, gas leaks, and other hazards, by sending alarms to utility companies, the fire department, and other emergency responders, and also emergency adjustment of electricity and gas connections. It has been asserted against Schneider Electric.
