On March 19, 2015, in an inter partes review ("IPR") filed by Unified Patents against Clouding IP, LLC ("Clouding IP"), the PTAB invalidated all challenged claims from U.S. Patent 6,738,799 B2 (the '799 patent). Clouding IP claims its patent covers generating update files from an earlier file version, and asserted the '799 patent against 6 companies in 2012, 4 companies in 2013, and 7 companies in 2014. The list of defendants includes Google, SAP AG, Verizon, Amazon, Rackspace, EMC Corporation, Dropbox, Microsoft, Apple, and Oracle.
The IPR was initially filed on September 16, 2013, as part of Unified Patent's NPE deterrent strategy in its Cloud Storage Zone. All of the challenged claims (claims 1, 5–10, 12, 16–21, 23, 24, 30, 31, 37, and 42) were held by the PTAB to be unpatentable.
